aerah.co (the “Website”) is owned and operated by Aerah Essentials Pvt. Ltd., a company incorporated under the Indian Companies Act, 2013 (referred to in this document as the “Company”, “we”, “us”, or “our”), with its registered office at 15/221-222, Malviya Nagar, New Delhi – 110017, South Delhi, Delhi, India.
Everything available on this Website including our products, content, and services is offered subject to these Terms and Conditions (“Terms”), our Privacy Policy, and any other policies published on the Website in connection with specific features, promotions, or services (together referred to as the “Policies”). All Policies are to be read together and form a single, binding framework governing your use of aerah.co.
In these Terms, “you” or “User” refers to any individual accessing or using this Website or its services. “We”, “us”, and “our” refer to Aerah Essentials Pvt. Ltd.
We may revise these Terms from time to time, at our discretion. It is worth checking this page periodically to stay up to date. Continuing to use the Website after any revisions are posted will be taken as acceptance of the updated Terms. Subject to your ongoing compliance, we grant you a personal, non-exclusive, non-transferable, and limited right to access and use this Website.

We are not in a position to accept responsibility for any loss or harm that results from another person using your account with or without your knowledge.

Skincare is deeply personal formulas that work beautifully for one person may not be the right fit for another, and certain ingredients may interact differently depending on an individual’s skin type, sensitivities, or health history

  • • Loss, corruption, or misdirection of data during transmission
  • • Any harm arising from third-party links appearing on the Website
  • • Viruses or technical malfunctions that may affect your device in connection with use of the Website or any linked external site
  • • Inaccuracies or omissions in any content published on the Website
  • • Events that fall outside our reasonable control, including technical failures or acts of third parties

  We put genuine thought and care into developing every aerah product. That said, we are not able to guarantee that every product will work the same way for every person. Skincare is, by its nature, individual. Before trying a new product, we encourage you to read through the ingredient list, directions for use, and any relevant caution notes. If you have known allergies, sensitivities, or any pre-existing skin or health conditions, speaking with a dermatologist beforehand is always a good idea. Aerah Essentials Pvt. Ltd. shall not be held responsible for any adverse reactions or health concerns arising from product use, particularly where usage instructions have not been followed or professional guidance has not been sought. In addition, and to the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, punitive, or consequential losses including loss of revenue or profit connected with your use of the Website, regardless of how such a claim arises.

• 4. PRODUCTS, SERVICES, AND PRICING

  We take care to ensure that the product descriptions, images, and pricing shown on aerah.co are accurate and up to date. That said, we cannot guarantee that every detail is entirely free from error at all times. Product images are intended to be representative, and minor differences in appearance, shade, or packaging may occur. Occasionally, the Website may contain a typographical error or information that has not yet been refreshed.
  We reserve the right to correct, update, or remove any content on the Website at any time, including after an order has been placed, and without prior notice. This may include changes to pricing, product details, and availability.
  A product’s price is only confirmed once your order has been acknowledged by us. In the event that a pricing or description error occurs due to a technical issue, we may need to cancel the affected order and issue a full refund, or reach out to you with the correct information before proceeding. If a payment has already been processed in such a case, the full amount will be returned to you without delay.

  Please note that prices and product availability on aerah.co may change from time to time, at our discretion. We will always aim to keep the Website as current as possible.

  We also reserve the right to withdraw or modify any product or service at any time. If we find ourselves unable to fulfil your order due to stock running out or a delay from our delivery partners, we will let you know by email and your order will be cancelled. We appreciate your understanding in such situations.

• 5. PAYMENT

  All orders on aerah.co are prepaid. We currently accept the following payment methods:

  Cash on Delivery (COD) is not available at this time.
  All payments are processed securely through Razorpay, our payment gateway partner. Aerah Essentials Pvt. Ltd. does not have access to or store your card or banking details at any point. • 6. SHIPPING AND DELIVERY

  All the information you need about how we dispatch orders, our courier partners, estimated delivery windows, and related logistics is available in our Shipping Policy, which is published separately on the Website and updated from time to time. By placing an order with us, you confirm that you have read and are comfortable with the terms set out there.

• 7. OUR RIGHTS AND OBLIGATIONS

  The following applies to how Aerah Essentials Pvt. Ltd. operates and manages aerah.co:

  • • We may update or amend these Terms from time to time. Any changes will be posted on the Website and will take effect immediately upon doing so.
  • • We reserve the right to suspend or close an account if we have genuine reason to believe that a user has acted in breach of these Terms, misused the Website, or behaved in a way that is harmful to others.   • • We shall similarly not be responsible for any changes to or discontinuation of the Website or its services where these are required in order to comply with a legal obligation or direction from a relevant authority.

• 8. INTELLECTUAL PROPERTY RIGHTS

  All content on aerah.co including the aerah name and logo, trademarks, product names, text, graphics, photography, video, audio, software, and the overall look and feel of the Website (collectively, the “Content”) belongs to Aerah Essentials Pvt. Ltd. and is protected under applicable Indian law, including legislation covering trademarks, copyright, and other forms of intellectual property.
  We ask that none of this Content be reproduced, adapted, distributed, sold, or otherwise used in whole or in part without our prior written permission, except as expressly permitted under these Terms or as required by applicable law.

• 9. LIMITED LICENCE

  In using aerah.co and accepting these Terms, you are granted a limited, personal, nonexclusive, non-transferable, and non-sublicensable licence to access and use the Website for your own personal, non-commercial purposes. All rights not expressly granted here remain with Aerah Essentials Pvt. Ltd. and its affiliates.
  We reserve the right to withdraw this licence at any time, including by limiting or removing your access to the Website, if we consider it appropriate to do so.

• 10. SPECIAL FEATURES AND PROMOTIONS

  From time to time, we may offer special features, campaigns, competitions, or other events on aerah.co. Where any of these come with their own additional terms or rules whether alongside or instead of these Terms we will let you know clearly. If you choose to take part, those additional terms will apply to you. Some events or features may be run in partnership with third parties, in which case their terms may also be relevant.

  aerah.co may include links to other websites or external services from time to time, for your convenience. These links are provided as a reference point only and should not be read as an endorsement of that content, product, service, or organisation. Accessing any external site is entirely at your own discretion and risk. We have no control over the content or practices of third-party websites and are not responsible for any experience or outcome that results from visiting them. • 12. INDEMNIFICATION

  You agree to indemnify and hold harmless Aerah Essentials Pvt. Ltd., its directors, employees, agents, and affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal costs) arising from: (a) a breach of any obligation under these Terms; or (b) use of the Website in a way that violates these Terms or applicable law, including through the use of automated tools or bots to access or extract data from the Website without our authorisation.

  If a dispute is not resolved through this process, it will be governed by the laws of India. The courts in New Delhi, India, will have exclusive jurisdiction, as though these Terms were entered into and performed entirely within New Delhi, subject to any mandatory provisions of applicable law.
  Any dispute that remains unresolved may be referred to arbitration under the Arbitration and Conciliation Act, 1996, as amended. Proceedings will be conducted before a sole arbitrator appointed by Aerah Essentials Pvt. Ltd., in English, with New Delhi as the seat of arbitration. The arbitrator’s award will be final and binding on both parties.
  No arbitration under these Terms will be combined with any other arbitration involving separate parties, including through class proceedings.
  Nothing in this clause limits our ability to seek urgent or interim relief from a competent court in New Delhi to protect our intellectual property, confidential information, or other legitimate interests, pending the resolution of any arbitration.

• 14. WEBSITE SECURITY

  To protect the integrity of aerah.co and the experience of all our users, we ask that you refrain from any activity that may compromise or attempt to compromise the security of the Website. This includes:

  • • Attempting to access data, accounts, or systems that you are not authorised to access
  • • Testing or scanning for vulnerabilities in our systems without our express written permission
  • • Attempting to disrupt or degrade the Website or its services in any way, including by submitting harmful code or engaging in denial-of-service activity

• 16. PRICING

  All product prices on aerah.co are listed in Indian Rupees (INR) and are inclusive of all applicable taxes, unless stated otherwise. Prices are incorporated into these Terms by reference. We reserve the right to revise pricing at any time, and we will always aim to ensure that the most current pricing is reflected accurately on the Website.

• 17. MRP DISCLAIMER

  The Maximum Retail Price (MRP) on aerah products may occasionally differ between our online store and any offline retail channels, depending on the manufacturing date or import date of a particular batch. In all cases, the MRP printed on the individual product’s packaging is the declared price for that unit and takes precedence.

• 18. PACKAGING

  Sustainability matters to us at aerah. As part of our commitment to reducing unnecessary waste, some of our products may not include additional packaging elements such as inner lids or individual safety seals, where these are not essential to the safety or integrity of the product.
  We also fill our products with a little extra headspace to help prevent leakage in transit. You may notice that the product level sits slightly below the rim of the container, or that the formula has moved around a little during delivery. This is completely normal and is not an indication of a shortage or a product defect.

• 19. TERMINATION

  These Terms remain in effect for as long as you continue to use the Website, unless brought to an end earlier by either party.
  You are free to stop using aerah.co at any time, which will effectively terminate these Terms on your side. We too may bring these Terms to an end at any time, which may include withdrawing your access to the Website. We will not incur any liability as a result of doing so.
  Upon termination, we would ask that you delete or destroy any materials downloaded from aerah.co, including any copies. Termination does not release you from any payment obligations already incurred, nor does it affect any rights or liabilities that arose before the termination took effect.

  These Terms and Conditions, together with our Privacy Policy and all other Policies on aerah.co, represent the complete agreement between you and Aerah Essentials Pvt. Ltd. with respect to your use of the Website. They take precedence over any prior discussions or agreements on the same subject

If we do not insist on the performance of a particular provision of these Terms on any occasion, this does not constitute a waiver of that right at a later time.
